The Nest Toy Library Membership Agreement
The following has been established to make borrowing toys from The Nest an enjoyable and consistent experience for all of our members. Please don’t hesitate to contact us with any questions or concerns.
Members are defined as person(s) who have active memberships with The Nest and are in good standing. Members can be a parent/legal guardian, or caregiver who has agreed to become a member on behalf of themselves and/or their child(ren). Within this document this parent/legal guardian will be referred to as “Member(s)”.
“Rental Period” is the amount of time the Member has possession of one group of toys. This period may not exceed two (2) weeks.
“Agreement Period” is the length of time the Member selects to have an active membership with The Nest. All Agreement Periods are required to be prepaid in full.
Members of The Nest Toy Library must purchase a membership to gain access to the toy library catalog. The membership will be issued to the adult who is legally responsible for the child(ren) for whom the membership will benefit. This adult is legally responsible for compliance with the membership terms included in this agreement.
The Member will select from the membership options below:
____ 1 Month Trial Membership - $25 - Choose up to 3 toys at a time
____ Sparrow - $20/month - Choose up to three (3) toys per each Rental Period (3 or 6 month commitment)
____ Meadowlark - $30/month - Choose up to five (5) toys per each Rental Period (3 or 6 month commitment)
____ Owl - $40/month - Choose up to eight (8) toys per each Rental Period (3 or 6 month commitment)
The number of toys checked out by any Member shall not exceed the limit as stated above, based on your membership level. Toy reservations are on a first-come, first-served basis. Toys must be reserved before the deadline established by The Nest Toy Library in order to be picked up on the next “Swap Day”.
Toys may only be returned and exchanged on “Swap Days”, which are predetermined by The Nest Toy Library. Toys may be checked out for a maximum of two (2) weeks. At this time renewal of toys is not permitted.
If a borrowed toy is not returned on or before the 2 week limit, or prior to the expiration of the membership term, the Member will be assessed a fine.
Additional toys may not be checked out by Members with overdue toys, outstanding fines or fees, or who are not in good standing with The Nest Toy Library.
Memberships expire at the end of the prepaid membership term. Members will receive notification of upcoming expiration. All Membership sales are final.
Members are encouraged to inspect toys and count the pieces and components of the toys upon picking them up.
All toys are the responsibility of the Member while on loan. Members are asked to treat the toys, bags, and packaging with care. Members should thoroughly clean and inspect toys prior to return, and toys should be returned in the box/bag they were checked out in.
If a piece has been misplaced, you may return the toy and continue to look for the missing piece for 24 hours after the “Swap Day”. If the piece cannot be located, The Nest Toy Library may impose a fee to replace the part/toy.
If items are returned in an unsatisfactory condition, damage fees will be applied. The damage fee will be an estimated cost based on replacing the toy. It is at the discretion of The Nest Toy Library what level of damage constitutes a damage fee.
10. The Nest Toy Library reserves the right to suspend or cancel the membership and/or toy borrowing privileges of anyone who violates these terms.
The Nest Toy Library Liability Agreement
- Members of the Toy Nest Library are responsible for the safety of anyone who uses or utilizes a toy, game or puzzle borrowed from the Toy Nest Library.
- Members are expected to supervise those who are using or utilizing a toy, game or puzzle borrowed from the Toy Nest Library.
- The Toy Nest Library assumes no liability for any activity or actions of any child or adult that engage with toys, games or puzzles borrowed from the Toy Nest Library.
- The Toy Nest Library makes no guarantees or warranties as to the safety of any item checked out from the Toy Nest Library.
- It is the responsibility of the Member to determine the appropriateness of any toy for use by the child. The Member assumes responsibility for ensuring the safe and proper use of each item checked out from the Toy Nest Library.
- The Member shall inspect each toy, game or puzzle prior to the use of the item and shall be responsible for ensuring there is no damage or defects to the toy upon receiving it as well as prior to return of the item(s) to the Toy Nest Library.
- If a toy, game or puzzle is discovered to be damaged or defective, the Subscriber shall immediately discontinue the use of the item(s) and immediately contact the Toy Nest Library to arrange the return of the item.
COVID-19 Policy
- The Nest is committed to doing everything we can to keep you and your family safe during the COVID-19 pandemic. Here are the steps we are taking in order to do so:
- Swap Days will be socially distanced, and no contact will be necessary to pick up your toys. If you arrive at the same time as another family, please stay in your car until the area is cleared, or give at least 6 feet of space between you. Please wear your mask if you see any other family picking up toys at the same time.
- Upon return, each toy will be thoroughly cleaned and disinfected with our all natural disinfecting spray (safe for little hands and mouths).
- Each toy will have a mandatory 24 hour waiting period before being checked out by another family.
- Our team will prioritize cleanliness including hand washing and sanitizing of surfaces and work areas related to the library. We will be wearing masks during any interaction with you and your family.
